Article 1: Definitions

Evolute Limited is a Limited Liability Company that aims to offer online courses related to cryptocurrency.

In these General Terms and Conditions, the term 'General Terms and Conditions' refers to these present General Terms and Conditions.

In these General Terms and Conditions, 'Client' refers to the natural person who does not act for purposes related to their trade, business, or professional activity and uses the Services of Evolute Limited.

In these General Terms and Conditions, 'Parties', and each individually as 'Party', refers to Evolute Limited and/or Client.

In these General Terms and Conditions, 'Agreement' refers to the Agreement concluded between Evolute Limited and Client, where Evolute Limited commits to providing Services and delivering Products to Client, and Client commits to paying a price for this. The Agreement is concluded by an offer from Evolute Limited and its acceptance by Client.

In these General Terms and Conditions, 'Services' refers to all Services provided to Client by Evolute Limited and/or third parties engaged by it, including offering online courses related to cryptocurrency, as well as all other work carried out by Evolute Limited on behalf of Client, of any nature, carried out within the framework of an assignment, including work carried out without the express request of Client.

In these General Terms and Conditions, 'Website' refers to the Website of Evolute Limited, accessible via https://www.evolutetrading.com

Article 2: Applicability of these Terms

These general terms and conditions apply to every offer and every agreement where Evolute Limited is a party.

Before you enter into an agreement with Evolute Limited, Evolute Limited will make the text of these general terms and conditions available to you. If this is not possible, Evolute Limited will indicate how you can view the general terms and conditions at Evolute Limited before concluding the agreement. Upon your request, Evolute Limited will send you the terms as soon as possible at no cost.

If the agreement is concluded remotely (electronically), Evolute Limited can (contrary to clause 2.2), before you conclude the agreement, make the text of these general terms and conditions available to you electronically. You can then easily save these terms.

Evolute Limited may always change its general terms and conditions. Evolute Limited will notify you of the change of terms via its website and possibly by email.

The new general terms and conditions will only apply to existing agreements between us if you agree to them.

If one or more provisions of these terms are null and void or destroyed, all other provisions of these terms will remain in effect.

Article 3: The Offer of Services

An offer may be valid for a certain period or subject to certain conditions. If so, Evolute Limited will clearly state this in the offer.

In the offer, Evolute Limited will fully and accurately describe the offered products, digital content, and/or services. Based on this, you can make a proper assessment of the offer.

Obvious mistakes or obvious errors in the offer do not bind Evolute Limited.

Article 4: The Agreement

The agreement is concluded by ticking 'I agree with the payment' online.

Immediately after concluding the agreement, you will receive a confirmation from Evolute Limited, usually by email.

As long as Evolute Limited has not confirmed your order, you can cancel the agreement (Article 11).

Evolute Limited ensures a secure web environment for the agreement concluded remotely (electronically). If you pay electronically, Evolute Limited also takes appropriate security measures.

These general terms and conditions are part of the agreement.

For one-time services or subscriptions, you get direct access (but no later than 24 hours) to digital content. Once you have viewed 25% of the digital content (the online course) within the 14-day cooling-off period, your right of withdrawal expires. You must explicitly agree to this expiration of your right of withdrawal during the online ordering process before placing and paying for the online course. You will receive confirmation of this by email. If you do not agree with this condition, no agreement will be formed between us, and Evolute Limited is not obliged to provide the one-time service to you. You will not get access to the online course.

Article 5: Right of Withdrawal (Cooling-off Period) and When It Expires

You have a statutory cooling-off period of 14 days.

The consumer has the right to cancel a remotely concluded agreement within 14 (fourteen) days free of charge and without giving any reason (Right of Withdrawal).

For the Client, the Agreement can no longer be canceled if Evolute Limited fully provides the services within the 14 (fourteen) days cooling-off period. When concluding the agreement, the Client gives Evolute Limited permission and declares to waive the right of withdrawal. Furthermore, the Client retains the Right of Withdrawal if the services are partially provided within the 14 (fourteen) days cooling-off period at the Client's request. However, the Client is obliged to pay for the services already provided.

During the cooling-off period, you can cancel without giving reasons.

The cooling-off period starts the day after the conclusion of our agreement.

For one-time services or subscriptions related to expert advisors (EA). Once you have logged into the online dashboard of Evolute Limited (https://dashboard.evolutetrading.com) or used the Discord within the 14-day cooling-off period, your right of withdrawal expires.

As an addition to this service, a free 30- to 60-minute onboarding conversation can be held with the client. The client is responsible for scheduling this. Once the conversation is held, the right of withdrawal expires.

You must explicitly agree to this expiration of your right of withdrawal during the online ordering process before placing and paying for the Expert Advisors/trading bots. You will receive confirmation of this by email. If you do not agree with this condition, no agreement will be formed between us, and Evolute Limited is not obliged to provide the one-time service to you. You will not get access to the online services.

Article 6: The "Not Funded, Money Back" Guarantee

The Client can only cancel the Agreement if the Client no longer has a right of withdrawal.

The client has purchased more than 5 (=five) Funded accounts from the recommended brokers/funding platforms or other recommended brokers and lost them. This includes buying an account, using our trading robots (EA) according to the recommended guidelines described in the course and community.

Each account requires a minimum trading period of 3 months. If more accounts are purchased within this period, it counts as one account. Therefore, there must be at least 15 months of trading. If the client has not passed any accounts through the evaluation period, they are entitled to 3 months free after the 12-month period. If the client has taken a package that is valid for less than a year, this guarantee does not apply.

The client has read about the risks, including how to set up the robot themselves.

The client has tested all settings in the trading robot and knows exactly what went wrong. This can be done using the instructional videos.

The client has not used prop firms with unreasonable market conditions. This includes prop firms that have changed their rules, preventing the robots from trading.

The guarantee does not apply if prop firms change rules, market conditions change, or other matters cause the client to lose their trading account.

The client can demonstrate what went wrong and that it was the trading robots' fault.

The client can show the trading history.

The client has not manually traded on the accounts, including manually closing positions.

The client has deposited sufficient funds in the accounts for the robots to trade.

The client has set up the trading robots on a VPN/server that is on 24/7 with good latency/execution or internet speed to execute orders with the broker or prop firm.

The accounts mentioned here are exclusively “funded accounts.” These are provided by an external party, called “Propfirms.” Examples include “https://www.ftmo.com” and other similar, independent companies separate from Evolute Limited.

The client has claimed the guarantee within 1 year of purchase.

The client has asked for help from the team within 6 months of purchase or filed a complaint.

We only reimburse based on evidence, such as trading history, that the client has followed the rules. We are not liable for damage or loss resulting from the sale of our products. We reserve the right to adjust the guarantee based on legal changes or market conditions. In case of doubt, consult us for more information.

If the client has achieved at least one account, this guarantee also expires. Due to the highly unpredictable nature of the financial markets and the fact that own companies have the final say on who is funded and who is not, no refunds can be made once the service fees are paid. Only when the claim to Evolute Limited is approved will the refund be processed.

Evolute Limited is not liable for more than the amount paid to Evolute Limited.

There is explicitly no refund of the purchase amount possible if the 14-day cooling-off period has expired, and the client does not meet the above requirements.

If the client has agreed to extended access, called: "Lifetime access," this guarantee expires. "Lifetime access" only applies as long as Evolute Limited offers its services. Evolute Limited is not liable to continue offering its services after this. The reason is that the client can now trade "lifetime" and thus has no time pressure to achieve accounts. Given the current results, guidance, and updates, it is possible to achieve at least one account within the "lifetime access" period. The client has fully paid their subscription and has no outstanding bills or periodic subscriptions running. If the client has achieved at least one account, this guarantee also expires.

The "Not Funded, Money Back" guarantee only applies if the above rules are followed. If the client does not meet the above rules, the "Not Funded, Money Back" guarantee cannot be claimed, and the client has no right to this refund. The client must then follow the "Lifetime access" terms and conditions as described above.

Article 7: Exercising the Right of Withdrawal

Within the cooling-off period, you can terminate the agreement by sending an email to Evolute Limited via support@evolutetrading.com. You can also use the model withdrawal form for this. This form is included at the bottom of these general terms and conditions.

After canceling the agreement, you will stop using our services.

Evolute Limited will confirm receipt of your email as soon as possible.

If you exercise your right of withdrawal, you must pay Evolute Limited a proportional amount of the total price for the services provided by Evolute Limited before exercising your right of withdrawal.

Evolute Limited will refund as soon as possible but no later than 14 days after termination.

Evolute Limited uses the same payment method for reimbursement that you used for payment, unless you agree to another method. The refund is free of charge for you.

Evolute Limited will refund all amounts paid by you, except for any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by Evolute Limited.

Article 8: Informed Consent

The Client declares that they have been informed and are aware of the risks of trading in cryptocurrency. The Client agrees that all information provided by Evolute Limited and/or its instructors, including the contents of the Evolute Limited Online Course, the Evolute Limited website, and all other Evolute Limited Services, is for educational purposes only and does not constitute financial, investment, tax, or legal advice or a recommendation.

Evolute Limited makes no guarantee, advice, promise, or assurance regarding the likelihood of any outcome. The Client understands and agrees that they are solely responsible for their decisions, actions, and results in trading. Evolute Limited and/or its instructors cannot be held liable for any loss or damage resulting from the Client's trading activities or any information provided by Evolute Limited and/or its instructors.

Article 9: Executing the Agreement

Evolute Limited gives you access to its services within 24 hours after concluding the agreement.

All services are performed by Evolute Limited based on a best-efforts obligation unless explicitly agreed otherwise.

Evolute Limited cannot guarantee that the result intended by you will be achieved by using its services.

Article 10: Duration and End of the Agreement

For agreements for one-time services or products, our agreement lasts as long as Evolute Limited offers the services.

For periodic services or subscriptions, our agreement lasts until one of us terminates it.

You can terminate our agreement for periodic services or subscriptions at any time without notice.

Article 11: Termination of the Agreement

If one of the Parties is in default in fulfilling its obligations under this agreement, the other Party is entitled to terminate the agreement without judicial intervention unless the shortcoming does not justify the termination.

The agreement can be terminated immediately without prior written notice in the event of bankruptcy or suspension of payments of the other Party or the cessation of the business of the other Party.

Article 12: Force Majeure

Evolute Limited is not obliged to fulfill any obligation towards you if it is hindered due to a circumstance that is not attributable to fault and neither by law, a legal act, or prevailing opinions in traffic.

Force majeure includes in any case, but is not limited to, power outages, strikes, government measures, pandemics, disruptions in transport, fire, storm, flood, terrorism, explosion, war, force majeure at suppliers, and failures in a (telecommunications) network or connection or used communication systems.

Article 13: Prices

The prices mentioned in the offer of services or products are inclusive of VAT and other government levies, as well as any costs to be incurred within the framework of the agreement unless otherwise indicated.

Evolute Limited can increase its prices at any time. Evolute Limited will notify you of this at least one month in advance via email and/or via its website. You can then terminate the agreement within 14 days of notification.

Article 14: Payment Terms

For one-time services, you pay Evolute Limited directly when concluding the agreement.

For periodic services, you pay Evolute Limited monthly in advance via direct debit.

If the direct debit fails, you are immediately in default. Evolute Limited will then suspend your access to its services until you pay the outstanding amount.

Article 15: Intellectual Property (Copyright)

All works created by Evolute Limited are protected by copyright.

Using these works without Evolute Limited's consent is an infringement of copyright.

In the event of an infringement, Evolute Limited may request you to cease the infringement immediately.
